Our executor process
Step 1: Confirm estate details
We confirm the full extent of the estate and ensure that all interested and affected parties are aware of the details.
Step 2: Secure and insure assets
We ensure that all assets in the estate are held securely and insured properly in the interest of the beneficiaries.
Step 3: Dispose of assets
If required by the will or necessary because of a cash shortfall in the estate, we’ll work with you to dispose of assets in an efficient and effective way.
Step 4: Handle tax obligations
We complete and lodge all outstanding income tax returns with the South African Revenue Services and take care of any capital gains tax obligations.
Step 5: Submit liquidation and distribution account
This account sets out how the estate should be distributed among beneficiaries and includes a calculation of any estate duties that need to be paid. We submit this account to the Master of the High Court in a timely manner.
Step 6: Transfer assets and distribute cash
We proceed with the asset transfer and cash distribution to beneficiaries, as outlined in the will, once the Master of the High Court has approved the liquidation and distribution account .
Who can act as an executor?
An individual, like a family member or a close friend, or an institution, such as a bank or trust company, can provide executor services. When nominating an executor in your will, it’s important to consider their experience, knowledge and ability to fulfil their responsibilities.
